The need for the axiological determinants of cognition of law to be theoretically justified as a constituent of legal progress that includes the humanization of law makes the problem under the study relevant. The purpose of this article is to distinguish the value determinants of cognition of law. The main methodological approaches used in the study are axiological and anthropological approaches, which allow us to consider law as a valuable constituent of human life, inextricably linked with the human personality. Starting from the idea that functions are formally similar to actions in that they are described and explained in a similar way, so that both admit of an accordion effect, I turn to Anscombe’s insight that the point of practical reasoning is to render explicit the relation between the different descriptions of an action generated by the accordion effect. The upshot is, roughly, that an item has a function if what it does can be accounted for by functional reasoning. While there are satisfactory answers to the question “How should we teach children mathematics?”, there are no satisfactory answers to the question “What mathematics should we teach children?”. This paper provides an answer to the last question for preschool children (early childhood), although the answer is also applicable to older children. This answer, together with an appropriate methodology on how to teach mathematics, gives a clear conception of the place of mathematics in the children’s world and our role in helping (...) children develop their mathematical abilities. Briefly, children’s mathematics consists of the world of children’s internal activities that they eventually purposefully organize in order to understand and control the outside world and organize their overall activities in it. We need to support a child in mathematical activities that she does spontaneously and in which she shows interest, and we need to teach her mathematics that she is interested in developing through these activities. In doing so, we must be fully aware that the child’s mathematics is part of the child’s world of internal activities and is not outside of it. We help the child develop mathematical abilities by developing them in the context of her world and not outside of it. From the point of view of this conception, the standards established today are limiting and too focused on numbers and geometric figures: these topics are too prominent and elaborated, and other mathematical contents are subordinated to them. Adhering to the standards, we drastically limit the mathematics of the child’s world, hamper the correct mathematical development of a child, and we can turn her away from mathematics. (shrink)

Boris Kment takes a new approach to the study of modality that emphasises the origin of modal notions in everyday thought. He argues that the concepts of necessity and possibility originate in counterfactual reasoning, which allows us to investigate explanatory connections. Contrary to accepted views, explanation is more fundamental than modality.

We further investigate a divisibility relation on the set of BN ultrafilters on the set of natural numbers. We single out prime ultrafilters (divisible only by 1 and themselves) and establish a hierarchy in which a position of every ultrafilter depends on the set of prime ultrafilters it is divisible by. We also construct ultrafilters with many immediate successors in this hierarchy and find positions of products of ultrafilters.

Many philosophers have argued that statistical evidence regarding group characteristics (particularly stereotypical ones) can create normative conflicts between the requirements of epistemic rationality and our moral obligations to each other. In a recent article, Johnson-King and Babic argue that such conflicts can usually be avoided: what ordinary morality requires, they argue, epistemic rationality permits. In this article, we show that as data get large, Johnson-King and Babic’s approach becomes less plausible. More constructively, we build on their project and develop a (...) generalized model of reasoning about stereotypes under which one can indeed avoid normative conflicts, even in a big data world, when data contain some noise. In doing so, we also articulate a general approach to rational belief updating for noisy data. (shrink)

We construct and study structures imitating the field of complex numbers with exponentiation. We give a natural, albeit non first-order, axiomatisation for the corresponding class of structures and prove that the class has a unique model in every uncountable cardinality. This gives grounds to conjecture that the unique model of cardinality continuum is isomorphic to the field of complex numbers with exponentiation.

In this paper we develop a general theory of algorithmic fairness. Drawing on Johnson King and Babic’s work on moral encroachment, on Gary Becker’s work on labor market discrimination, and on Strawson’s idea of resentment and indignation as responses to violations of the demand for goodwill toward oneself and others, we locate attitudes to fairness in an agent’s utility function. In particular, we first argue that fairness is a matter of a decision-maker’s relative concern for the plight of people from (...) different groups, rather than of the outcomes produced for different groups. We then show how an agent’s preferences, including in particular their attitudes to error, give rise to their decision thresholds. Tying these points together, we argue that the agent’s relative degrees of concern for different groups manifest in a difference in decision thresholds applied to these groups. (shrink)

I propose a general alethic theory of epistemic risk according to which the riskiness of an agent’s credence function encodes her relative sensitivity to different types of graded error. After motivating and mathematically developing this approach, I show that the epistemic risk function is a scaled reflection of expected inaccuracy. This duality between risk and information enables us to explore the relationship between attitudes to epistemic risk, the choice of scoring rules in epistemic utility theory, and the selection of priors (...) in Bayesian epistemology more generally. The paper deals with the question of the attribution to Epicurus of the classification of pleasures into 'kinetic' and 'static'. This classification, usually regarded as authentic, confronts us with a number of problems and contradictions. Besides, it is only mentioned in a few sources that are not the most reliable. Following Gosling and Taylor, I believe that the authenticity of the classification may be called in question. The analysis of the ancient evidence concerning Epicurus' concept of pleasure is made according (...) to the following principle: first, I consider the sources that do not mention the distinction between 'kinetic' and 'static' pleasures, and only then do I compare them with the other group of texts which comprises reports by Cicero, Diogenes Laertius and Athenaeus. From the former group of texts there emerges a concept of pleasure as a single and not twofold notion, while such terms as 'motion' and 'state' describe not two different phenomena but only two characteristics of the same phenomenon. On the other hand, the reports comprising the latter group appear to derive from one and the same doxographical tradition, and to be connected with the classification of ethical docrines put forward by the Middle Academy and known as the divisio Carneadea. In conclusion, I argue that the idea of Epicurus' classification of pleasures is based on a misinterpretation of Epicurus' concept in Academic doxography, which tended to contrapose it to doctrines of other schools, above all to the Cyrenaics' views. The aim of Modality and Explanatory Reasoning (MER) is to shed light on metaphysical necessity and the broader class of modal properties to which it belongs. This topic is approached with two goals: to develop a new and reductive analysis of modality, and to understand the purpose and origin of modal thought. I argue that a proper understanding of modality requires us to reconceptualize its relationship to causation and other forms of explanation such as grounding, a relation that connects metaphysically (...) fundamental facts to non-fundamental ones. While many philosophers have tried to give modal analyses of causation and explanation, often in counterfactual terms, I argue that we obtain a more plausible, explanatorily powerful and unified theory if we regard explanation as more fundamental than modality. The function of modal thought is to facilitate a common type of thought experiment – counterfactual reasoning – that allows us to investigate explanatory connections and which is closely related to the controlled experiments of empirical science. Necessity is defined in terms of explanation, and modal facts often reflect underlying facts about explanatory relationships. The study of modal facts is important for philosophy not because these facts are of much metaphysical interest in their own right, but largely because they provide evidence about explanatory connections. We continue the research of an extension of the divisibility relation to the Stone‐Čech compactification. First we prove that ultrafilters we call prime actually possess the algebraic property of primality. Several questions concerning the connection between divisibilities in and nonstandard extensions of are answered, providing a few more equivalent conditions for divisibility in. Results on uncountable chains in are proved and used in a construction of a well‐ordered chain of maximal cardinality. Probably the most interesting result is the existence of (...) a chain of type in. Finally, we consider ultrafilters without divisors in and among them find the greatest class. (shrink)

Evidential decision theory (EDT) says that the choiceworthiness of an option depends on its evidential connections to possible outcomes. Causal decision theory (CDT) holds that it depends on your beliefs about its causal connections. While Newcomb cases support CDT, Arif Ahmed has described examples that support EDT. A new account is needed to get all cases right. I argue that an option A's choiceworthiness is determined by the probability that a good outcome ensues at possible A‐worlds that match actuality in (...) the facts causally unaffected by your decision (the “unaffected facts”). Moreover, you should evaluate A on the assumption that A is compossible with the unaffected facts. This view entails that you should use EDT when evaluating A on the assumption that the unaffected facts determine your action, but use CDT when assessing A on the opposite assumption. A's choiceworthiness equals a weighted average of these conditional assessments. The weights are determined by your beliefs about whether the unaffected fact determine your action. This account gets both Newcomb and Ahmed cases right. According to an influential view, whether you take the unaffected facts to determine your action can make a difference to whether you can regard yourself as free and the action as being under your control. While my account is neutral on this issue, it entails that whether you take the unaffected facts to determine your action is important in a different way: it matters to whether you should follow EDT or CDT. Although the brain enables us to perceive the external world and our body, it remains unknown whether brain processes themselves can be perceived. Brain tissue does not have receptors for its own activity. However, the ability of humans to acquire self-control of brain processes indicates that the perception of these processes may also be achieved by learning. In this study patients learned to control low-frequency components of their EEG: the so-called slow cortical potentials (SCPs). In particular ''probe'' sessions, the patients (...) estimated the quality of the SCP shift they had produced in the preceding trial. The correspondence between the recorded SCP amplitudes and the subjective estimates increased with training. The ability to perceive the SCPs was related to the ability to control them; this perception was not mediated by peripheral variables such as changes in muscle tonus and cannot be reduced to simple vigilance monitoring. These data provide evidence that humans can learn to perceive the neural activity of their brain. Alternative interpretations are discussed. (shrink)

This text is a polemic against the 2023 article by Sergey N. Gradirovsky who wrote about the present-day relevance of Immanuel Kant’s concept of enlightenment and challenged the idea of the modern human being as a child who needs an external guardian or guide to control his behaviour. In my polemic with Gradirovksy I point out that in addition to “self-incurred immaturity” Kant writes about the historical “immaturity” of savage or backward peoples. I also argue that for Kant “maturity” carries (...) not only biological but also socio-historical connotations. I show that in the modern world Kant’s idea of the social or even historical maturity of the modern human acquires serious problematisation which was shown to be possible and inevitable in the article “What Is Enlightenment?” (1784) and its notion of the historicity of enlightenment, i.e. the very strategy of modernity is possible only when humankind reaches a certain historical age. Using as a point of departure the ideas of the French philosopher Michel Foucault, I maintain that the Kant­ian conception of enlightenment is at once ironic and tragic. It is ironic because it does not rule out that its main thesis on the historical maturity of the human being may turn out to be wrong. It is tragic because its main thrust is “heroisation of the present”, i.e. a readi­ness to resist the temptation of being absorbed by the future, which takes on added relevance in view of the virtualisation of reality. Transformation of the Constitutional System of the Slovak Republic Purpose of the article is to analyze the Constitutional Act No. 356/2011 Z. Coll. amending the Constitution of the Slovak Republic in terms of its compatibility of the constitutional system of the Slovak Republic. The article analyzes the potential impact of amendment to the Constitution of the Slovak Republic on the Parliamentary form of the government of the Slovak Republic and examine the consistency of Art. 115 Para 3 of the Constitution (...) of the Slovak Republic with another provisions that relate to it. The purpose of the article is to identify some problems that brought amendment to the Constitution of the Slovak Republic by the Constitutional Act No. 356/2011 Coll. of Art. 115 Para 3 and points out its incompatibility with the constitutional text. This article also discusses a possible shift in the parliamentary constitutional system of the Slovak Republic which the Constitutional Act brought.Methodology/methods used in the article is the analysis of the Constitutional Act No. 356/2011coll. by induction from the concrete wording of Art. 115 Para 3 of the Constitution of the Slovak Republic to the conclusions in relation to the entire text of the Constitution of the Slovak Republic and to the whole constitutional system of the Slovak Republic Scientific aim is to point to the shortcomings of the Constitutional Act No. 356/2011 Z. Coll., not only from the perspective of constitutional interpretation, but potentially also in terms of practice and also show the wrong trend of breaking the internal unity and coherence of the constitutional system of the Slovak Republic by half-baked changes to the text of the Constitution of the Slovak Republic Findings are specific and severe systemic disorders that brought the amendment to the Constitution of the Slovak Republic by the Constitutional Act No. 356/2011 Coll. of Art. 115 Para 3. The Article identifies three concrete problems and the subsequent practice may bring some other issues that were not known at the time of processing of this Article Conclusions are directed to the fact, that the Constitutional Act No. 356/2011 Coll. means internal disturbance of the constitutional system of the Slovak Republic, brings more problems than constructive solutions and potentially deflects the parliamentary constitutional system of the Slovak Republic to the semi-presidential. This paper explores the use of new scientific techniques to examine collections of historic scientific apparatus and other technological artefacts. One project under discussion uses interferometry to examine the history of lens development, while another uses X-ray fluorescence to discover the kinds of materials used to make early mathematical and astronomical instruments. These methods lead to surprising findings: instruments turn out to be fake, and lens makers turn out to have been adept at solving the riddle of aperture. Although exciting, (...) in some ways this is neither novel nor particularly unusual. After all, lab techniques have been used in art and archaeological collections for a very long time. In fact, scientific instruments themselves have been examined in this way since at least the 1950s. What, then, is special about the use of new instruments to examine old instruments? We argue that the answer has less to do with measuring historical innovation or establishing priority, and more to do with networks of craft know-how that, typically, have left no other historical traces than those embodied in surviving instruments themselves. We show, in particular, how collections of objects can be mobilised within wider histories of knowledge, placing instruments within a dynamic interplay of craft knowledge, expertise, labour, commerce, and material exchange, over the longue durée. Finally, we suggest that these kinds of lab analyses can be given an extra dimension through the use of computational modelling, and we introduce the “Tools of Knowledge” project, which is designed to bring together XRF with techniques from the digital humanities, in order to tell a new story about the development of scientific instruments from the 16th to the 20th century. This article outlines the emergence of Husserl’s theory of ‘communication proper’ ( Mitteilung or Kommunikation) in the context of his genetic analyses of intersubjectivity. It defines the meaning and function of Mitteilung in contradistinction with the notion of empathy and thus demonstrates its distinct generative constitution. I propose that Mitteilung has the capacity to cancel the ‘operative’ opposition between social acts and instinctive intersubjectivity and thus to frame a non-determinist theory of sociality. This capacity is largely ignored by the dominant (...) interpretation, according to which the concept of communication in Husserl is derivative of the more fundamental category of empathy. A major consequence to this argument is that it determines why eminent readers of Husserl such as Derrida have missed an important opportunity when they failed to notice the distinct role of Mitteilung. This alternative view is expanded onto communication media in general by taking Kittler’s project as a vantage point. (shrink)

We continue the research of the relation $\hspace {1mm}\widetilde {\mid }\hspace {1mm}$ on the set $\beta \mathbb {N}$ of ultrafilters on $\mathbb {N}$, defined as an extension of the divisibility relation. It is a quasiorder, so we see it as an order on the set of $=_{\sim }$ -equivalence classes, where $\mathcal {F}=_{\sim }\mathcal {G}$ means that $\mathcal {F}$ and $\mathcal {G}$ are mutually $\hspace {1mm}\widetilde {\mid }$ -divisible. Here we introduce a new tool: a relation of congruence modulo an (...) ultrafilter. We first recall the congruence of ultrafilters modulo an integer and show that $=_{\sim }$ -equivalent ultrafilters do not necessarily have the same residue modulo $m\in \mathbb {N}$. Then we generalize this relation to congruence modulo an ultrafilter in a natural way. After that, using iterated nonstandard extensions, we introduce a stronger relation, which has nicer properties with respect to addition and multiplication of ultrafilters. Finally, we introduce a strengthening of $\hspace {1mm}\widetilde {\mid }\hspace {1mm}$ and show that it also behaves well with respect to the congruence relation. (shrink)

Aristotelian ideas have in the past been applied with mixed fortunes to quantum mechanics. One of the most persistent criticisms is that Aristotle’s notions of potentiality and actuality are burdened with a teleological character long ago abandoned in the natural sciences. Recently this criticism has been met with a model of the actualization of quantum potentialities in light of Aristotle’s doctrine of ‘spontaneous events’. This presumably restores the nowadays acceptable idea of efficient causation in place of Aristotle’s original doctrine of (...) the ‘four causes’. In this article I challenge the model by arguing that when properly scrutinized Aristotle’s final cause poses no problems for an Aristotelian reading of quantum mechanics. Final causes in fact provide a better ontology for quantum mechanics than spontaneous causation. The idea of ‘spontaneity’ is unanalyzable and therefore of little use in quantum mechanics. In addition, it is ontologically sterile in the context of quantum measurement, as shown by a historical and conceptual review of the role of efficient causation in experimental physics. (shrink)

On the received view, counterfactuals are analysed using the concept of closeness between possible worlds: the counterfactual 'If it had been the case that p, then it would have been the case that q' is true at a world w just in case q is true at all the possible p-worlds closest to w. The degree of closeness between two worlds is usually thought to be determined by weighting different respects of similarity between them. The question I consider in the (...) paper is which weights attach to different respects of similarity. I start by considering Lewis's answer to the question and argue against it by presenting several counterexamples. I use the same examples to motivate a general principle about closeness: if a fact obtains in both of two worlds, then this similarity is relevant to the closeness between them if and only if the fact has the same explanation in the two worlds. I use this principle and some ideas of Lewis's to formulate a general account of counterfactuals, and I argue that this account can explain the asymmetry of counterfactual dependence. The paper concludes with a discussion of some examples that cannot be accommodated by the present version of the account and therefore necessitate further work on the details. (shrink)

Technologies and practices aimed at improving the physical, mental, intellectual, moral and other characteristics of a person are becoming increasingly popular today. What makes all this possible is the present stage of scientific and technological development of society, often referred to as technoscience. This article discusses two general contours of what constitutes a technoscience. The author argues that, internally, technoscience is associated with establishing increasingly close and diverse links between science and technology. Externally, technoscience incorporates other components, such as business, (...) financing the development of new technologies, a human as an individual person and, at the same time, as a mass consumer of new technologies, and society, through which the relations between all other blocks of the eireuit are carried out. What is claimed to be of crucial importance is the fact that very often becomes the target of a variety of technological interventions. For a long time, such interventions have been primarily medical, therapeutic in their nature. Gradually, however, the spectrum of applications of biomedical technologies has grown wider. A significant role in this widening ofthe spectrum during last few decades is claimed to be played by processes of medicalization of human life. The author considers the delineation between therapeutic interventions and those which are aimed at improving an individual. He addresses the problems of the connection between the projects of human enhancement, on the one hand, and their radical transformation, on the other. (shrink)

We continue the exploration of various aspects of divisibility of ultrafilters, adding one more relation to the picture: multiplicative finite embeddability. We show that it lies between divisibility relations \ and \. The set of its minimal elements proves to be very rich, and the \-hierarchy is used to get a better intuition of this richness. We find the place of the set of \-maximal ultrafilters among some known families of ultrafilters. Finally, we introduce new notions of largeness of subsets (...) of \, and compare it to other such notions, important for infinite combinatorics and topological dynamics. (shrink)

Approximate coherentism suggests that imperfectly rational agents should hold approximately coherent credences. This norm is intended as a generalization of ordinary coherence. I argue that it may be unable to play this role by considering its application under learning experiences. While it is unclear how imperfect agents should revise their beliefs, I suggest a plausible route is through Bayesian updating. However, Bayesian updating can take an incoherent agent from relatively more coherent credences to relatively less coherent credences, depending on the (...) data observed. Thus, comparative rationality judgments among incoherent agents are unduly sensitive to luck. (shrink)

Drawing from cognitive learning theories we hypothesize that exposure to nationalistic appeals that suggest consumers should shun foreign brands for moral reasons increases the general belief in consumers that buying foreign brands is morally wrong. In parallel, drawing from the theory of psychological reactance we posit that such appeals may, against their communication goal, increase the reputation of foreign luxury brands. We term the juxtaposition of these apparently contradictory effects the “Ambivalence Hypothesis.” Further, drawing from prior research on source-similarity effects (...) we posit that foreign luxury brands that communicate cultural proximity to target consumers (i.e., a local brand positioning) reinforce psychological reactance (“Clean Conscience Hypothesis”). We test these hypotheses experimentally in the context of luxury car brand advertising in China, a market that is heavily dominated by foreign brands, and therefore provides a breeding ground for ambivalent consumer reactions. Results show that exposure to nationalistic appeals enhances consumers’ national identity dispositions (patriotism, local identity), which results in higher levels of consumer ethnocentrism. Further, nationalistic appeals enhance the social responsibility associations that consumers hold for foreign luxury brands and their countries of origin, which results in a higher brand reputation. Finally, effects of nationalistic appeals on foreign luxury brand reputation are positively stronger for brands using a local vs. a foreign or a global positioning. These findings suggest that nationalistic appeals are a double-edged sword with important implications for ethics in political communication and luxury brand marketing. (shrink)
